Home Seller's HandbookUnderstanding the Real Estate Disclosures There may be numerous disclosures that may be filled out by you and I (or your Realtor). Some of the more important forms are the Seller's Disclosure, the Homeowner's or Condo Association's Disclosures, the Lead-Based Paint Disclosure, and the Natural Hazard Disclosure. These forms are used to disclose certain facts about the property, so the buyer knows about the property's defects, or expenses, or issues impacting the property. There are various time periods in which a buyer is legally to receive these disclosures. The Seller's DisclosureThis is a disclosure that is filled out by you, the seller, and the listing agent, who represents you, and is signed by you and the buyer. This disclosure discloses all known material defects in the property. Me or your agent should fill out this form before listing your property, since the buyer's agent will ask to see this disclosure before putting in an offer on your house. Lead Based Paint Disclosure (for houses build prior to 1978)This disclosure informs the buyer if you, the seller have any knowledge of having any lead-based paint in your house. You, as the seller, are also obligated to provide your buyer (usually through me or the agent), a booklet that explains the hazards of lead-based paint. |
